Legal troubles plagued Vancouver man, accused in designer drug …

A tall businessman named Ryan A. “Bo” Scott drove to the Port of Portland on Feb. 16, 2011, to pick up a shipment of merchandise from Lima, Peru. He told a U.S. Customs and Border Protection official that he was importing a soft drink additive. But his invoice described the package as a powdered plant insecticide called “Orisha summoning powder.”

Customs seized the goods. Within five weeks, according to a government search warrant affidavit, federal agents identified the powder as 4-methylethcathinone,? a synthetic drug that when snorted, swallowed or injected delivers a high likened to that of cocaine, speed and ecstasy.

Agents learned that Scott, who runs KTW Enterprises Ltd. out of a 3,000-square-foot warehouse in Vancouver, had received two other shipments — through Oakland, Calif., and Anchorage, Alaska — from Peru.. One manifest listed the product as incense, according to the affidavit, the other as “Asian burial powder.”

Prosecutors now accuse Scott, 31, and three other people of taking part in an international conspiracy to manufacture and sell designer drugs online and to gas stations, convenience stores and head shops, with proceeds exceeding $5 million between 2009 and earlier this month.

Scott, listed in public records as the president and secretary of KTW, went from collecting unemployment benefits to personally amassing $1.8 million in just 18 months, Assistant U.S. Attorney Leah K. Bolstad alleged in a court hearing this week.

The arrests of Scott, in Vancouver, and accused co-conspirator Alexandre Valentinov Dimov in Hawaii this week climaxed a major investigation in the government’s escalating war on designer drugs — synthetic marijuana sold as K2 and a class of stimulants known as cathinones, which are often sold as bath salts.

But veteran defense lawyer Janet Hoffman, who represents Scott, described her client in court as a lawful businessman who pays taxes and sells products that are legal “but annoying to the government.”

Lawsuit alleges trademark infringement?

Scott incorporated KTW out of an address in Lake Oswego on Feb. 2, 2010, and his legal troubles soon followed.

On Nov. 10, 2010, the owners of a Kansas company, Bouncing Bear Botanicals Inc. accused KTW, Scott, Dimov and a company doing business as Allegrand Enterprises of infringing on the K2 trademark. Bouncing Bear and KTW had both used the name K2 to license a wide array of similar domain names to run their businesses.

Scott’s company would eventually license more than 50 domain names, including K2drugs.com, legalweedstore.net and the company’s primary web site, k2incense.org, the government alleges.

The civil suit eventually settled out of court. But Scott’s real troubles were only beginning. On March 1, 2011, just 13 days after customs officials seized his shipment of powders from Peru, the Drug Enforcement Administration issued an emergency order to control five chemicals, all of them synthetic cannabinoids used to make what government agents call “fake pot.”

Manufacturers have created the synthetic marijuana by coating plant materials with chemicals that mimic THC, the active ingredient in marijuana. The products, sold in slick packages, have become increasingly popular with teens and young adults seeking legal highs.

But poison control centers and health departments across the United States have reported a litany of side effects from the drugs, including nausea, seizures, hallucinations, racing hearts, tremors and non-responsiveness, according to a DEA official testifying last July before a congressional subcommittee on health.

Fights over phones, PCs, ‘inventory’

Hoffman fought much of last year trying to get the government to return her client’s plant materials and 14 electronic devices — including computers, iPhones and thumbdrives — seized from Scott in April 2011. The government returned some of the electronics, but not what Scott had described as “inventory.”

The legal battle renewed Tuesday, when federal agents arrested Scott at his home in Vancouver. He was jailed in Portland and brought to federal court Wednesday to face a six-count felony indictment. Scott, wearing blue jail scrubs, pleaded not guilty to all the charges before U.S. Magistrate Judge Paul J. Papak.

The indictment accuses Scott and Dimov, a 33-year-old Bulgarian national, of a conspiracy to manufacture, distribute and import controlled susbtances, launder money and introduce misbranded drugs into interstate commerce. Two other defendants — Nancy Gabaree, 50, and her 22-year-old daughter, Andrielle Gabaree, both of Las Vegas — were charged with money laundering.

The prosecutor argued during Scott’s detention hearing that even after the search of his business he had sold nearly identical K2-type products with different labels.

Such artificial drugs, known as analogues, are regulated by the federal Controlled Substances Act, which has established that the products — if substantially similar chemically to those being regulated and intended for human consumption — also are illegal.

Hoffman argued at Scott’s detention hearing that he no longer sells the products that prompted the earlier search of his property. “I don’t think you can find a more compliant person than Mr. Scott,” she said.

But the prosecutor told the judge that she had learned that morning from Hoffman that Scott was now selling skin rejuvenating cream. But, Bolstad said with a broad grin, federal agents were searching his warehouse at that very moment and had found nothing of the kind. What they found, she said,was the same plant material that had in the past been turned into analogue drugs.

Papak freed Scott from jail to await trial, but ordered him to relinquish his passport, not travel overseas and undergo drug testing.

This week, government agents seized six bank accounts in the case and shut down the main website used by Scott’s company, leaving in its place a note for the public: “This domain name has been seized by ICE — Homeland Security Investigations.”

Iran may seek “tactical gain” with U.N. nuclear deal

VIENNA (Reuters) – Iran and the U.N. nuclear watchdog are making headway towards a framework deal on how to tackle concerns about its atomic activity, diplomats say, a potential bargaining chip for Tehran in next week’s negotiations with world powers.

Iran says such an agreement is needed before it can consider a request by U.N. inspectors to visit the Parchin military site where they believe explosives tests relevant for developing nuclear weapons may have been carried out.

The International Atomic Energy Agency (IAEA) and Iran held talks this week in Vienna and are due to meet again on May 21, two days before Tehran and the six global powers discuss the future of its disputed nuclear program in Baghdad.

Western diplomats accredited to the U.N. agency said Iran seemed keen to agree a so-called “structured approach” – an outline of how to deal with the IAEA‘s questions – ahead of Baghdad in the apparent hope of gaining leverage there.

They say they would welcome any sign that Iran is prepared to stop stonewalling an almost four-year-old IAEA investigation based on Western intelligence suggesting Iran has researched ways to acquire the ability to produce nuclear bombs.

But they caution that it remains to be seen whether an understanding with IAEA is implemented in practice, saying Iran in the past has used haggling over procedural matters as a way to buy more time as its nuclear program advances.

It would be “a step forward on the process side,” one diplomat said about the possibility of an agreement to be announced on Monday, suggesting it would signal real progress “if it gets us to where we can finally address substance.”

He said it would be a relatively brief document on the scope and principles of how to pursue talks regarding possible military dimensions to Iran’s nuclear program: “No real details. Just a precursor to starting to ask real questions.”

The U.N. nuclear watchdog, tasked with preventing the spread of nuclear weaponry in the world, has made it clear it will only sign up to something that would enable it to carry out its investigation without restrictions, and not “tie our hands”.

Two previous rounds of talks in Tehran early this year failed to make any notable progress. But both sides were more upbeat after the May 14-15 meeting in the Austrian capital, raising hopes of a possible outcome when talks resume on Monday.

A non-Western envoy said: “Progress has been made. There are still one or two outstanding issues. My impression is that both sides have the willingness to move forward.”

Iran denies having a covert atomic bomb agenda, saying it is enriching uranium only for a future network of civilian nuclear power stations and a medical isotope reactor.

NUCLEAR PLEA-BARGAIN

Analyst Ali Vaez forecast a deal between the U.N. nuclear agency and Iran which could be both “substantive and symbolic” but the final resolution of the IAEA’s outstanding issues would depend on the outcome of higher-level diplomacy.

“For Iran, a tactical gain in Vienna can potentially become a strategic gain in Baghdad. Cooperation with the IAEA will put Iran one step ahead” of the six powers in the Iraqi capital, said Vaez, of the International Crisis Group think-tank.

But Iranian expectations of getting something in return for cooperating with the IAEA may be disappointed as any scaling back of sanctions would take an “incredible amount of time,” said analyst Gala Riani of Control Risks, a consultancy.

“We would need much more significant moves by Iran.”

The West’s main goal in Baghdad is to get Iran to stop the higher-grade uranium enrichment it started two years ago and has since expanded, shortening the time needed for any weapons bid. Iran says it needs the uranium enriched to a fissile purity of 20 percent for its medical research reactor.

Enriched uranium can be used to fuel nuclear power plants if refined to low levels, Iran’s stated aim, or provide the core of a nuclear bomb if processed to the 90 percent level – which the West fears is the Islamic Republic’s latent purpose.

Iran and the powers involved in nuclear diplomacy – the United States, Russia, China, Britain, France and Germany – revived negotiations in Istanbul last month after a 15-month hiatus during which the West sharpened sanctions to an unprecedented degree – targeting Iran’s oil trade and banks.

The resumption of diplomacy offers a chance to defuse that tension as well as worries about a new Middle East war.

Israel, widely thought to have the Middle East’s only nuclear arsenal and convinced a nuclear Iran would pose a mortal threat, has – like the United States – not ruled out air strikes to stop Iran’s atomic progress if it deems diplomacy has failed.

The IAEA wants Iran to address issues raised by an agency report last year that revealed intelligence pointing to past and possibly ongoing activity in Iran of use in developing the means and technologies needed to build atom arms.

Iran says the intelligence is fabricated, but the U.N. agency says its inspectors need access to sites, documents and officials to reach credible conclusions in its inquiry.

The IAEA’s priority is Parchin, where its report found that Iran had built a large containment vessel over a decade ago to conduct high-explosives tests that the U.N. agency said were “strong indicators of possible” nuclear weapon development.

Western diplomats say they suspect Iran is cleaning the site to remove incriminating evidence, a charge Tehran dismisses.

Karim Sadjadpour of the Carnegie Endowment think-tank said Iran had felt no incentive to be transparent with the IAEA about past illicit or weapons-related activities out of fear that doing so would only further incriminate Tehran.

“For an agreement to be reached I think Iran would have to be offered, and would have to accept, a nuclear plea-bargain,” Sadjadpour said.

New Evidence Suggests Comcast Prioritizing Its Own Streamed …

Growing questions are being raised about whether Comcast is violating FCC and Department of Justice policies that prohibit the cable company from prioritizing its own content traffic over that of its competitors.

Comcast?s Xfinity Xbox app offers Comcast customers access to Xfinity online video content without eating into their monthly 250GB Internet usage allowance. Netflix has called that exemption unfair, because its content does count against Comcast?s usage cap. New evidence now suggests Comcast may also be prioritizing the delivery of its Xfinity content over other broadband traffic, a true Net Neutrality violation if proven true.

Bryan Berg, founder and chief technology officer at MixMedia, believes he has found proof the cable company is giving its own video content preferential treatment, in this somewhat-technical finding published on his blog:

What I?ve concluded is that Comcast is using separate DOCSIS service flows to prioritize the traffic to the Xfinity Xbox app. This separation allows them to exempt that traffic from both bandwidth cap accounting and download speed limits. It?s still plain-old HTTP delivering MP4-encoded video files, just like the other streaming services use, but additional priority is granted to the Xfinity traffic at the DOCSIS level. I still believe that DSCP values I observed in the packet headers of Xfinity traffic is the method by which Comcast signals that traffic is to be prioritized, both in their backbone and regional networks and their DOCSIS network.

Berg also contends Comcast?s earlier explanation that its Xfinity content should be exempt from its usage cap because it travels over the company?s private Internet network is also flawed:

In addition, contrary to what has been widely speculated, the Xfinity traffic is not delivered via separate, dedicated downstream channel(s)?it uses the same downstream channels as regular Internet traffic.

Broadband traffic management is of growing interest to Internet Service Providers, who contend it can be used to manage Internet traffic more efficiently and improve speed and time-sensitive online applications like streamed video, online phone calls, and similar services. But manufacturers of traffic management equipment also market the technology to ISPs who want to favor certain kinds of content while de-prioritizing or even throttling the speed of non-preferred content. The technology can also differentiate traffic that counts against a monthly usage cap, and traffic that does not.

Quality of Service (QoS) technology can be used to improve the customer?s online experience or help a provider launch Internet Overcharging and speed throttling schemes that can heavily discriminate against ?undesirable? online traffic.

Berg further found that when he saturated his 25Mbps Comcast broadband connection, traffic from providers like Netflix suffered due to the bandwidth constraints.? Because he flooded his connection, Netflix buffered additional content (slowing his stream start time) and reduced the bitrate of the video (which can dramatically reduce the picture quality at slower speeds). But when he launched Xfinity video streaming, that traffic was unaffected by his saturated connection. In fact, he discovered Xfinity traffic was exempted from his normal download speed limit, allowing his connection to exceed 25Mbps.

While that works great for Xfinity fans who do not want their videos degraded when other household members are online, it is inherently unfair to competitors like Netflix who are forced to reduce the quality of your video stream to compensate for lower available bandwidth.

According to the consent decree which governs the merger of the cable operator with NBC-Universal, prioritizing traffic in this way is a no-no when the company also engages in Internet Overcharging schemes, namely its arbitrary usage cap:

?If Comcast offers consumers Internet Access Service under a package that includes caps, tiers, metering, or other usage-based pricing, it shall not measure, count, or otherwise treat Defendants? affiliated network traffic differently from unaffiliated network traffic. Comcast shall not prioritize Defendants? Video Programming or other content over other Persons? Video Programming or other content.?

This graph shows Berg’s artificially saturated 25Mbps Comcast broadband connection. The traffic in red represents Xfinity Xbox traffic, which is given such high priority, it allows Berg to exceed his usual download speed limit.

Comcast sent GigaOm a statement that denies the company is doing any such thing:

?It?s really important that we make crystal clear that we are not prioritizing our transmission of Xfinity TV content to the Xbox (as some have speculated). While DSCP markings can be used to assign traffic different priority levels, that is not their only application ? and that is not what they are being used for here. It?s also important to point out that our Xfinity TV content being delivered to the Xbox is the same video subscription that customers already paid for and is delivered to their home over our traditional cable network ? the difference is that we are now delivering it using IP technology to the Xbox 360, in a similar manner as other IP-based cable service providers. But this is still our traditional cable television service, which is governed by something known as Title VI of the Communications Act, and we provide the service in compliance with applicable FCC rules.?

Our View

Comcast, as usual, is talking out of every side of its mouth. In an effort to justify their unjustified usage cap, they have pretzel-twisted a novel way out of this Net Neutrality debate by paving their own digital highway on a Comcast private drive.

Comcast argues their 250GB usage cap controls last-mile congestion to provide an excellent user experience. That excuse completely evaporates in the context of its new toll-free video traffic. In fact, their earlier argument that its regionally-distributed streaming traffic should not count because it does not travel over the ?public Internet? at Comcast?s expense does not even make sense.

Berg provides an example:

A FaceTime call from my house to my neighbor?s?which never leaves even the San Francisco metro area Comcast network, given that both of us are Comcast customers?goes over the ?public Internet.?

Yet Comcast?s Xbox streams, which pass from Seattle to Sacramento to San Francisco through all of the same network elements that handle my video call (and then some!) are exempt from the bandwidth cap?

You can?t have it both ways, guys.

DOCSIS 3 technology has vastly expanded the last mile pipe into subscriber homes. If Comcast can launch their own private pipe for unlimited IPTV traffic that travels down the same wires their Internet service does, they can comfortably handle any additional capacity needs to support their ?constrained? broadband service without the need to limit their customers? use.

Usage caps remain an end run around Net Neutrality. Consumers given the opportunity to view content under a usage cap on the ?public Internet? or using the ?toll-free? traffic lane Comcast created for content from their ?preferred partners? will make the obvious choice to protect their usage allowance. Comcast is certainly aware of this, and it is a clever way to discriminate through social engineering. It?s also less obvious. You don?t have to de-prioritize or block traffic from your competition to have an impact, you just have to limit it. Customers who repeatedly exceed their usage allowance face suspension of Comcast broadband service for up to one year. That?s a strong incentive to follow their rules.

Netflix is fighting to force Xfinity traffic to fall under the same arbitrary usage cap regime Netflix endures ? a truly shortsighted goal. The real issue here is whether Comcast should be capping any of its Internet service.

Comcast has given us the answer, launching the very bandwidth-intense video streaming it used to decry was contributing to an Internet traffic tsunami.

It?s time for Comcast to drop its usage cap.

Google Music users learned of a frightful new policy this morning that dictates a user may de-authorize only four devices in a year, out of ten total activations. While the policy is likely to go unnoticed by the majority of consumers, it instantly created a great pain for those who regularly flash ROMs to their phones and tablets. It seems the road to de-authorization hell is paved with good intentions, however, as Google has since responded to critics with the revelation that it’ll introduce an activation system that accounts for such nuances.

We’ve determined through our own experimentation that Google has temporarily suspended the de-authorization limit of four devices, and while it’s difficult to know how long this reprieve will last, we’re hopeful that it’ll remain in effect until Google implements this new system to recognize duplicate authorizations. Additionally, we’ve learned through our conversations with the company that users may, in fact, sign in to their Google Music account from any number of devices, and it’s only when a tune is deliberately streamed that your smartphone or tablet will be added to the list of ten.

What’s more, while the company was rather insistent that songs couldn’t be streamed to multiple devices at the same time, it seems that Google’s system of checks and balances is spotty at best — we were able to simultaneously stream tunes to three devices without so much as a hiccup. Yes, the system eventually shook its finger at us, but it serves as a nice reminder to have fun while the insanity lasts.

As a refresh, I reviewed the cans last week and found that it really came down to like vs. love. They’re fine, but I can’t necessarily justify a $60-$70 purchase. John felt the same way when we sat down to chat about the Hesh headphones in this latest episode of Fly or Die. But it extends far beyond that. As John would say, “friends don’t let friends buy bad headphones.”

(NaturalNews) Treatment with vitamin D supplements may slow the progress of prostate cancer, according to a study published in the journal BJU International.

In the United States, prostate cancer is the second leading cause of cancer death among men, after lung cancer. Approximately 240,000 new cases are diagnosed every year, leading to 30,000 deaths.

Researchers have suspected for nearly two decades that the so-called ?sunshine vitamin? may play a role in the risk and progression of prostate cancer, but no studies have previously been conducted on its usefulness as a treatment.

?It?s very interesting – there has been no significant trial of vitamin D,? said lead researcher Jonathan Waxman of Imperial College London. ?This is a treatment which is unlikely to have significant toxicity and is a welcome addition to the therapeutic options for patients with prostate cancer.?

Waxman decided to do the study when he learned of a prostate cancer patient who recovered after his wife bought vitamin D pills for him. Waxman and colleagues recruited 26 men with prostate cancer and assigned them each to take a daily vitamin D supplement. In five of the men, reductions in levels of the prostate specific antigen (PSA) were reduced.

In men with prostate cancer, PSA levels are an indicator of disease severity. One participant experienced a decrease in PSA levels less than 25 percent, two experienced decreases of between 25 and 50 percent, and two experienced decreases of more than 50 percent. In one of the participants, PSA levels remained reduced for a full 36 months.

Vitamin D is synthesized by the body upon exposure to ultraviolet (UV) radiation from sunlight. It plays a critical role in calcium absorption and bone health, and deficiency in the vitamin can lead to rickets in children and osteoporosis in adults. Recent research has also suggested that vitamin D can help prevent autoimmune disorders and a variety of chronic diseases, including diabetes, heart disease and cancer. Some scientists have stated that if everyone increased the amount of time they spent in the sun, far more lives would be saved from cancers prevented than would be lost from increased skin cancer cases.

A light-skinned person can get enough vitamin D from getting 15 minutes of sun on the face and hands each day, while a darker skinned person might need up to 45 minutes. More sun exposure is needed at more extreme latitudes.
